Welcome to EASY CHEETAH (PTY) LTD ("Easy Cheetah," "we," "our," or "us"). These Terms & Conditions govern access to and use of easycheetah.co.za, courses.easycheetah.com, the Easy Cheetah online course library, downloadable learning materials, videos, exercises, study methods, and related support services (collectively, the "Services").

Easy Cheetah provides an educational programme designed to help students develop practical learning skills, including goal setting, motivation, focus, stress management, reading efficiency, memory techniques, visual learning, study planning, and examination strategy.

By visiting our website, purchasing the Easy Cheetah programme, creating an account, accessing course materials, or allowing a student or child in your care to use the Services, you agree to be bound by these Terms & Conditions.

If you do not agree to these Terms, you must not purchase, access, or use the Services.


AGREEING TO THESE TERMS & CONDITIONS

These Terms apply to:

Visitors to our websites;

Parents, guardians, and other adults who purchase the programme;

Students who access or use the programme;

Customers who create or manage an Easy Cheetah account; and

Any other person who accesses the Services through an authorised account.

PLEASE READ THESE TERMS CAREFULLY BEFORE PURCHASING OR USING THE EASY CHEETAH PROGRAMME.

By purchasing or using the Services, you confirm that:

You are at least 18 years old or otherwise have the legal capacity to enter into a binding agreement;

Where the programme is purchased for a child or minor, you are that student’s parent, legal guardian, or an adult authorised to make the purchase;

You consent to the child or student accessing and using the programme;

The information you provide is accurate and complete;

You accept responsibility for activity conducted through your account; and

You agree to comply with these Terms and all applicable laws.

Students under the age of 18 may use the Services only with the involvement and permission of a parent, legal guardian, or other responsible adult.

These Terms, together with our Privacy Statement and any published Guarantee or Refund Policy, constitute the agreement between you and EASY CHEETAH (PTY) LTD.

If there is a conflict between these Terms and a specific written offer displayed at checkout, the specific written offer will apply to that purchase to the extent of the conflict.

We may update these Terms by publishing a revised version on our website. Changes will apply prospectively from the date on which they are published, unless applicable law requires otherwise.


SECTION 1 – WEBSITE AND COURSE USE

You may use the websites and Services only for lawful, personal, and educational purposes.

You agree not to:

Use the Services for an unlawful or fraudulent purpose;

Attempt to gain unauthorised access to our websites, course platform, accounts, servers, or systems;

Interfere with the security or proper operation of the Services;

Introduce viruses, malicious code, automated scraping tools, or other harmful technologies;

Copy, download, record, reproduce, republish, or distribute course content except where we expressly permit a download;

Share your account or login credentials with people outside your immediate household;

Resell, sublicense, teach, publish, or commercially exploit our course materials;

Remove copyright, trademark, or proprietary notices from our materials;

Misrepresent your identity, age, authority, or relationship to a student; or

Use our content to create a competing course, training programme, or commercial product.

We may restrict, suspend, or terminate access where we reasonably believe that an account has been misused or these Terms have been breached.


SECTION 2 – INTELLECTUAL PROPERTY

The Easy Cheetah programme and all associated content are owned by or licensed to EASY CHEETAH (PTY) LTD and are protected by copyright, trademark, and other intellectual property laws.

Protected content includes, without limitation:

Course modules;

Instructional videos;

Audio recordings;

Worksheets;

Goal-setting matrices;

Study timetables;

Focus exercises;

Motivation systems;

Relaxation and mindfulness exercises;

Speed-reading techniques and drills;

Memory techniques;

Visualisation methods;

Examination strategies;

Downloadable materials;

Written explanations;

Graphics, illustrations, and photographs;

Website copy and design;

The Easy Cheetah name, logo, and branding; and

The structure, arrangement, and presentation of the programme.

Subject to these Terms, Easy Cheetah grants the purchasing customer and the intended student a limited, revocable, non-exclusive, non-transferable licence to access and use the programme for personal educational purposes.

Unless we provide written permission, you may not:

Copy or reproduce the course;

Record course videos or audio;

Upload the course to another platform;

Sell or redistribute any course material;

Share course materials publicly;

Provide access to schools, classes, tutoring groups, or unrelated third parties;

Modify or create derivative products from the course;

Use the materials to provide paid training or tutoring; or

Claim ownership of Easy Cheetah content or methods.

Any permitted worksheets or downloadable resources may be printed or used by the purchasing household for personal educational purposes only.


SECTION 3 – PRIVACY AND STUDENT INFORMATION

Our collection and processing of personal information are governed by our Privacy Statement.

Where a parent or guardian purchases the programme for a child, the parent or guardian is responsible for ensuring that any personal information provided about that child is submitted lawfully and with the necessary authority or consent.

You should not submit sensitive medical, psychological, educational, or diagnostic information through our general website forms unless specifically requested and reasonably necessary for us to provide support.


SECTION 4 – ACCOUNT REGISTRATION AND ACCESS

Access to the course library may require an account on courses.easycheetah.com or another platform operated or approved by Easy Cheetah.

You are responsible for:

Providing accurate registration information;

Maintaining the confidentiality of your login credentials;

Preventing unauthorised access to your account;

Ensuring that the account is used only by the purchasing customer, the intended student, and authorised members of the same household;

Maintaining access to the email address associated with the account; and

Notifying us promptly if you suspect unauthorised access.

Course access may not be transferred, resold, or assigned to another household without our written permission.


SECTION 5 – COURSE OFFER AND INCLUDED CONTENT

The Easy Cheetah programme is a self-paced digital learning course intended to teach students how to approach studying, reading, memory, focus, and examinations more effectively.

The programme may include the following core subject areas:

Academic Goal Setting and Motivation Mastery;

The Performance Mindset, Stress Management, and Focus;

The Information Accelerator and Speed Reading;

Memory Mastery and Visual Learning; and

Exam Strategy and High-Performance Test-Taking.

The specific lessons, exercises, videos, downloads, names of modules, and presentation of the course may be updated, reorganised, replaced, or improved from time to time.

Unless expressly stated in writing, the purchase does not include:

Individual psychological assessment;

Medical treatment;

Diagnosis of a learning condition;

Individual tutoring;

Private coaching;

School placement services;

Academic accreditation;

Guaranteed access to Paul Tosio personally;

Guaranteed marks, grades, or examination results; or

Any service not specifically included on the applicable sales or checkout page.


SECTION 6 – ORDERS, PRICING, AND PAYMENT

The price displayed at checkout is the price applicable to your purchase, subject to correction of obvious technical or pricing errors.

The Easy Cheetah core programme is currently presented as a once-off purchase rather than a monthly subscription. The advertised price may change for future purchases, promotions, or different versions of the programme.

Where the course is advertised at R597 once-off, this means:

One payment of R597 is charged for the advertised course access;

No monthly course subscription fee applies to that purchase;

Access is provided after successful payment, subject to technical processing and account activation; and

The purchase is covered by the guarantee described in Section 8.

Payment must be successfully authorised before course access is provided.

Payments may be processed by third-party payment providers. Easy Cheetah does not necessarily receive or store your complete payment-card information.

We may refuse or cancel an order where:

Payment is unsuccessful or reversed;

Fraud or unauthorised payment is suspected;

An obvious pricing or technical error occurred;

The purchaser provided materially inaccurate information; or

The transaction violates applicable law or a payment provider’s rules.

SECTION 7 – DIGITAL DELIVERY AND INSTANT ACCESS

The Easy Cheetah programme is delivered digitally.

After successful payment, course access is generally made available through:

An on-screen confirmation;

An email containing login or access instructions; or

The Easy Cheetah online course platform.

References to "instant access" mean that access is normally activated automatically or shortly after payment. Access may occasionally be delayed by payment verification, email delivery issues, maintenance, internet outages, platform disruptions, or circumstances outside our reasonable control.

You are responsible for:

Providing a valid email address;

Checking spam, junk, promotions, and filtered email folders;

Maintaining a compatible internet-connected device;

Maintaining adequate internet access; and

Contacting support if access instructions are not received.

Because the programme is delivered electronically, no physical shipping or delivery is included unless a specific physical product is expressly offered.


SECTION 8 – 30-DAY MONEY-BACK GUARANTEE

The Easy Cheetah programme is offered with a 30-day money-back guarantee where that guarantee is displayed on the applicable sales or checkout page.

Under this guarantee, you may request a refund within 30 calendar days from the original purchase date if you are not satisfied with the programme.

The guarantee is intended to be straightforward and is described as a "no-questions-asked guarantee." You are not required to prove that the programme failed or provide detailed reasons for your request.

The purchaser’s name;

The email address used at checkout; and

The order number, where available.

Approved refunds will be returned to the original payment method where reasonably possible. The time taken for funds to appear may depend on the relevant bank, card issuer, payment provider, or payment method.

The guarantee:

Applies to the original Easy Cheetah course purchase;

Must be exercised within 30 calendar days of purchase;

Does not provide multiple refunds for repeat purchases by the same customer or household;

Does not cover fraudulent, abusive, or unauthorised use of the refund process; and

Does not limit any non-excludable rights you may have under applicable South African consumer law.

Once a full refund has been processed, your licence to use the programme ends and Easy Cheetah may deactivate course access.


SECTION 9 – LIFETIME ACCESS

Where the course is sold with "lifetime access," this means access for the operational lifetime of the applicable Easy Cheetah course and course platform, subject to these Terms.

Lifetime access:

Is linked to the original purchasing account;

Does not create a transferable ownership right in the course;

Does not permit resale or account sharing outside the authorised household;

Does not guarantee that every lesson, platform feature, file format, or technology will remain unchanged indefinitely;

May be delivered through a replacement platform if our technology changes; and

Remains subject to reasonable maintenance, security, legal, and operational requirements.

Easy Cheetah may update, replace, restructure, or improve course content without removing the essential educational value of the purchased programme.

Access may be suspended or terminated if the account is used unlawfully, shared in breach of these Terms, used to copy or redistribute the course, or obtained through a fraudulent or reversed payment.


SECTION 10 – EDUCATIONAL PURPOSE AND RESULTS DISCLAIMER

Easy Cheetah is an educational skills programme. It is designed to provide students with methods and strategies that may assist them with studying, reading, memory, motivation, focus, and examination preparation.

We do not guarantee:

Any particular school mark, grade, percentage, examination result, or academic ranking;

Admission to a school, university, course, or profession;

That a student will double their reading speed or academic performance;

That every student will experience the same outcome;

That a student will use or consistently apply the techniques;

That the programme will resolve every study difficulty;

That the programme will replace classroom teaching or subject-specific instruction; or

That improvement will occur within a particular period.

Statements such as "read faster," "remember more," "study smarter," "twice the output," or references to average improvements describe the programme’s objectives, techniques, reported experiences, or illustrative outcomes. They are not promises that every student will achieve a specified result.

Results vary depending on factors including:

The student’s age and educational level;

Baseline reading and study skills;

Practice and consistency;

Motivation and engagement;

The nature and difficulty of the subject;

School and home environment;

Language proficiency;

Individual learning needs; and

The extent to which the techniques are understood and applied.

The purchasing adult and student remain responsible for deciding how and when the techniques are used.


SECTION 11 – HEALTH, PSYCHOLOGICAL, AND LEARNING-DIFFICULTY DISCLAIMER

The Easy Cheetah programme includes general educational content relating to motivation, focus, relaxation, mindfulness, examination stress, memory, and learning techniques.

The programme is not a substitute for:

Medical care;

Psychological treatment;

Psychiatric care;

Occupational therapy;

Educational psychology services;

Remedial education;

Learning-support services;

Diagnosis of ADHD, anxiety, dyslexia, or another condition; or

Advice from a qualified healthcare or educational professional who has assessed the individual student.

References to psychology, psychological principles, mindfulness, guided imagery, eye-position techniques, music, stress management, or brain-based learning are provided for general educational purposes.

No part of the programme should be interpreted as diagnosing, treating, curing, or preventing a medical, psychological, neurological, developmental, or learning condition.

Parents and guardians should seek appropriate professional advice where a student has, or may have:

ADHD;

Anxiety;

Dyslexia;

A visual or hearing impairment;

A neurological or developmental condition;

Significant examination distress;

Persistent academic difficulty; or

Any condition requiring individual support or accommodation.

A student should discontinue an exercise and seek appropriate assistance if it causes discomfort, distress, dizziness, visual strain, or another adverse reaction.


SECTION 12 – PARENT, GUARDIAN, AND STUDENT RESPONSIBILITIES

Parents, guardians, and adult purchasers are responsible for:

Deciding whether the programme is suitable for the student;

Supervising use where appropriate for the student’s age;

Ensuring that the student uses the Services safely and lawfully;

Supporting reasonable and healthy study practices;

Ensuring that study exercises do not replace adequate sleep, rest, nutrition, or necessary professional care; and

Seeking professional support where the student’s needs extend beyond a general educational course.

Students are responsible for:

Participating honestly and responsibly;

Practising the techniques consistently where they choose to use them;

Following school and examination rules;

Avoiding dishonest academic conduct; and

Asking a parent, teacher, or qualified professional for help where necessary.

The term "Legal Crib Notes," where used in the course or marketing, refers to lawful memory cues or visual study prompts. It does not authorise prohibited notes, cheating, undisclosed assistance, or violation of examination rules.


SECTION 13 – TESTIMONIALS, RESULTS, AND ENDORSEMENTS

Our website may display testimonials, reviews, reported marks, student experiences, parent feedback, school names, media references, or examples of results.

Testimonials describe the experiences of particular individuals. They do not guarantee that another student will achieve the same or similar outcome.

Individual statements may have been shortened or edited for clarity, spelling, grammar, or length without intentionally changing their meaning.

Where a customer voluntarily submits a review, testimonial, photograph, video, or success story, the customer grants Easy Cheetah permission to use that material for reasonable promotional, educational, and marketing purposes, subject to applicable privacy and consent requirements.

We will obtain appropriate permission before intentionally publishing identifying content relating to a minor where required by law.

References to schools, media outlets, organisations, or public figures do not necessarily mean that those parties currently endorse, sponsor, or are formally affiliated with Easy Cheetah unless expressly stated.


SECTION 14 – COURSE AVAILABILITY AND TECHNICAL REQUIREMENTS

We aim to keep the course reasonably accessible but do not guarantee uninterrupted or error-free availability.

Access may be temporarily interrupted because of:

Planned maintenance;

Security updates;

Platform changes;

Hosting-provider outages;

Internet disruptions;

Payment-provider issues;

Events outside our reasonable control; or

Measures required to protect customers, data, or intellectual property.

We may update the technical format or hosting platform used to provide the course.

You are responsible for using a reasonably current browser, device, operating system, internet connection, and software capable of accessing ordinary web-based video and downloadable materials.


SECTION 15 – THIRD-PARTY SERVICES

Easy Cheetah may use third-party services for:

Payment processing;

Website hosting;

Course delivery;

Video hosting;

Email delivery;

Analytics;

Customer support; and

Authentication or account management.

Your use of certain third-party services may also be subject to the provider’s terms and privacy practices.

We are not responsible for independent third-party websites or services that are not owned or controlled by Easy Cheetah.


SECTION 16 – DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the websites and Services are provided on an "as is" and "as available" basis.

Easy Cheetah does not warrant that:

The Services will always be uninterrupted or error-free;

Every feature will be compatible with every device;

Every student will understand or benefit from every technique;

Course content will meet every individual educational need; or

The Services will produce a particular academic result.

Nothing in these Terms excludes a warranty, right, or remedy that cannot lawfully be excluded under applicable South African law.


SECTION 17 – LIMITATION OF LIABILITY

To the maximum extent permitted by law, EASY CHEETAH (PTY) LTD and its directors, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss arising from or connected with the Services.

This includes, without limitation:

Lost academic opportunities;

Disappointing marks or examination results;

Loss caused by failure to apply the course techniques;

Loss of data;

Device or internet incompatibility;

Temporary platform unavailability; or

Reliance on the programme as a substitute for individual professional advice.

Where our liability cannot lawfully be excluded, it will be limited to the remedies and amounts permitted under applicable law.

Nothing in these Terms is intended to exclude liability for fraud, gross negligence, wilful misconduct, or any other liability that cannot legally be excluded.


SECTION 18 – INDEMNITY

To the extent permitted by law, you agree to indemnify EASY CHEETAH (PTY) LTD, its directors, employees, contractors, and service providers against third-party claims, liabilities, losses, or reasonable costs arising from:

Your unlawful use of the Services;

Your unauthorised copying or distribution of course content;

Your breach of these Terms;

Your infringement of another person’s rights; or

Fraudulent or abusive activity conducted through your account.

This provision does not require a consumer to indemnify Easy Cheetah for loss caused by Easy Cheetah’s own unlawful conduct, gross negligence, or other liability that cannot legally be transferred.


SECTION 19 – COPYRIGHT AND INTELLECTUAL PROPERTY COMPLAINTS

If you believe that material available through our Services infringes your copyright or other intellectual property rights, contact us and provide:

Your name and contact details;

Identification of the protected work;

Identification of the allegedly infringing material;

The location of that material;

A description of your rights; and

A statement confirming that the complaint is made in good faith.

We may remove or restrict access to disputed material while investigating a complaint.


SECTION 20 – ACCEPTABLE EDUCATIONAL USE

Easy Cheetah teaches learning and examination-preparation methods. You must use these methods consistently with school rules, examination regulations, and academic-integrity requirements.

The Services may not be used to:

Cheat in an examination or assessment;

Conceal prohibited materials;

Misrepresent another person’s work as your own;

Circumvent school or examination-security rules;

Facilitate plagiarism; or

Engage in dishonest academic conduct.

Memory aids, trigger images, note-compression methods, and examination strategies must be used only where lawful and permitted.


SECTION 21 – SUSPENSION AND TERMINATION

We may suspend or terminate access where:

These Terms are materially breached;

Course content is copied, resold, or distributed;

Login credentials are shared beyond permitted household use;

The account is used fraudulently or unlawfully;

Payment is reversed, disputed, or found to be unauthorised;

Continued access creates a security or legal risk; or

Access must be restricted to comply with law.

Where reasonably appropriate, we may provide notice and an opportunity to correct the breach before termination.

Termination does not affect rights or obligations that arose before termination.

Where a full refund is issued, course access may be terminated immediately.


SECTION 22 – DISPUTE RESOLUTION

If a concern or dispute arises, you agree to contact us first so that we have a reasonable opportunity to investigate and resolve it.

The parties will attempt to resolve disputes through good-faith communication.

Nothing in these Terms prevents a consumer from exercising rights available under applicable South African consumer protection law, approaching a competent regulator, using an applicable statutory dispute-resolution process, or bringing proceedings before a court with jurisdiction.


SECTION 23 – GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa.

Subject to applicable consumer protection laws and jurisdictional rules, disputes relating to these Terms or the Services will be subject to the jurisdiction of the competent South African courts.


SECTION 24 – GENERAL PROVISIONS

Entire Agreement

These Terms, our Privacy Statement, the applicable checkout page, and any published Guarantee or Refund Policy form the agreement relating to your purchase and use of the Services.

Severability

If any provision is found to be unlawful, invalid, or unenforceable, that provision will be limited or removed to the minimum extent necessary. The remaining provisions will continue to apply.

No Waiver

A failure or delay by Easy Cheetah to enforce a provision does not constitute a waiver of that provision or any other right.

Assignment

You may not transfer your account, course access, or rights under these Terms without our written consent.

Easy Cheetah may transfer its rights and obligations as part of a legitimate restructuring, sale, merger, or transfer of the relevant business, subject to applicable law.

Changes to the Services

We may improve, update, reorganise, or replace parts of the Services. We will not intentionally remove the essential substance of a paid course without providing a reasonable alternative, except where continued provision is unlawful or no longer reasonably possible.
